Foreign judgments are not automatically enforceable in Turkey. In order to enforce a court judgment acquired in foreign countries, an enforcement lawsuit must be filed before the competent courts in Turkey and the decision rendered at the end of such a lawsuit should be finalized to be able to initiate the execution phase.
Although conditions for recognition and enforcement are expressly set forth in the applicable law (International Private Law), the question as to whether these conditions are fulfilled for a particular judgment should be handled delicately since each case has its own unique characteristics. Interpretation and proving of the fulfillment of each condition is another aspect that should be carefully considered. Foreign jurisdiction rules and practices, the existence of reciprocity, public order considerations, and the applicable precedents should be carefully approached and evaluated before filing for enforcement of a foreign judgment in Turkey.
