The Presidential Decree No. 3238 (the “Decree”) regarding extension of application period for short-time working payments has been published on the Official Gazette No. 31321 dated December 1st, 2020.
Short-time working allowance period, that was regulated subject to the principles as per the Temporary Article 23 of the Unemployment Insurance Law No. 4447, has been extended until December 31st for the workplaces having applied for short-time working allowance due to compelling reasons arising from COVID-19 pandemic. It should also be noted that the payments to be made within the scope of this Decree will not be deducted from the unemployment allowances granted before.
Accordingly, workplaces that have not applied for short-time working allowance until June 30th 2020 due to COVID-19 pandemic will have the opportunity to benefit from short-time working allowance for the three-months period after December 1st, 2020 provided that they apply to İŞKUR until December 31st 2020.
As for the workplaces that applied for short-time working allowance before, they will continue to benefit from short-time working allowances for their eligible employees without any necessity for new applications. However, these workplaces should submit new applications for their employees that were not eligible for short-time working before.
Additionally, short-time working payments for the workplaces having applied for short-time working allowance due to compelling reasons arising from COVID-19 pandemic until June 30th,2020 are deemed to be applied upon completion of one-week waiting-period regulated as per Articles 24/3 and 40 of the Labour Law No. 4857.
