An Important Milestone for Public Procurement Tenders in Turkey

A very important change on Public Procurement Procurement Tenders in Turkey: Forms of Public Procurement Contracts were amended on December 30th, 2017 with an effect of January 19th, 2018.

It has always been a crucial decision for foreign contractors and investors whether to bid for public procurement tenders in Turkey as there were no alternative dispute resolution mechanisms available under public tender contracts and the only method for resolution of disputes arising out of public tender contracts was litigation before the courts.

The amendment allows the public authorities to select arbitration and refer their possible disputes arising out of Turkish Public Tenders to local or international arbitration by simply adding an article to their respective public procurement contracts.

It is expected that this amendment will encourage foreign / international suppliers, contractors and investors to bid for Turkish Public Tenders more comfortably.
